Title II Website and Mobile Application Regulation Compliance Deadline Extended

Recently, one of the most requested training topics at the Northeast ADA Center has been the Department of Justice (DOJ) regulation on Accessibility of Web Information and Services of State and Local Government Entities. It has a large impact on Title II public entities as so much of our communications and information comes through the web, social media, and electronic communication. Under this rule, Title II public entities under the Americans with Disabilities Act (ADA) are required to meet specific standards for the accessibility of their web and mobile content.

The rule was published April 24, 2024, and set two compliance dates based on the population size an entity serves. Title II public entities with 50,000 or more people had until April 24, 2026, to comply. For those public entities with less than 50,000 people, the date was set for April 26, 2027.

Now, these compliance dates have been updated by the DOJ in the federal register.

For Title II public entities with a total population of 50,000 or greater, the effective date is now April 26, 2027. For public entities with a total population of less than 50,000, compliance is required as of April 26, 2028. The publication of the extension can be found in the federal register.

While this adds time for Title II public entities to address their web accessibility, the required standard has not changed or been adjusted.
